History of kratom legality in New York
Aside from the temporary ban the FDA placed on Kratom in 2016, there was only one other attempt to ban this herb in New York, 2017’s NY Assembly Bill 231. Had this bill become law, the use, sale and distribution of kratom would have been illegal across the state.
 
Luckily for kratom users, due to an outpouring of pro-kratom support on the bill, as well as two petitions from the General Assembly and Senate, the bill died in economic development.
 
The next couple of legislative attempts were mainly focused on the sale of kratom to minors. 2019 proposals NY S05531 and NY A08249 aimed to prohibit sale of kratom to individuals under 21 years of age, rather than the current 18+ restrictions, plus introduce fines and penalties for attempting to break this law. Both bills ultimately failed to come to fruition. 
 
Not all kratom legislation aims to be restrictive; the latest on New York’s kratom radar is Senate Bill 3588. A version of the kratom consumer protection act, this bill is a huge step in the right direction for protecting kratom rights and regulating manufacturing within the state. So, what would this bill aim to accomplish?
 
Senate Bill 3588 would:
  • Require vendors to clearly label kratom products, including a list of ingredients and suggested serving size
  • Ban the addition of dangerous non-kratom substances such as synthetic alkaloids or scheduled substances
  • Prohibit sale of kratom to minors (individuals under the age of 18)
  • Require vendors to disclose the content of 7-hydroxymitragynine and mitragynine on packaging label
  • Prohibit sale of kratom where 7-hydroxymitragynine makes up greater than 2% of the kratom’s overall alkaloid content
  • Establish penalties for vendors who would violate any provisions of the New York KCPA. First time offenders can expect a fine of no more than $500, with repeat offenders receiving a fine of no more than $1000 for each subsequent offense
  • Vendors may also receive a sentence of up to 90 days in jail, and be liable for any damages that may occur due to their negligence
 
The passage of this bill would make New York one of only a handful of states that have passed a version of the Kratom Consumer Protection Act. Currently the bill is sitting with the New York Senate Agriculture Committee awaiting action, with a positive outlook for kratom lovers.
