Is kratom legal in Colorado?

That’s an important question to ask before buying kratom near you! The short answer, in the state of Colorado, yes. Kratom is legal to buy, sell and use for those 21+ in most parts of Colorado. Kratom is currently illegal in the cities of Parker and Monument. If you live outside of the banned cities, you can buy kratom from a local retailer or you have the option to buy online and have kratom shipped to your door. The choice is yours!

Because kratom is not federally regulated, it is up to each state to develop and enforce legislation. Because of this, things like age requirements for using kratom are constantly changing and there are other states that are also divided within, making kratom legal in a state but not all cities, counties, or municipalities within that state. Be sure you understand your state and local laws regarding kratom before you make a purchase.

What is Kratom?
This botanical has been used by the native peoples in this region for centuries as a part of their holistic well-being, for lifting spirits, relaxing the body, and liberating the mind. All kratom comes from the dried leaves of the Mitragyna Speciosa tree, a species native to Southeast Asia and a relative to the coffee plant. It thrives in hot, humid climates making Southeast Asia the world’s top Kratom source. You can learn more about the kratom plant and its benefits here.

Only after reaching their peak of perfection, leaves are hand-picked by Kratom farmers with years of experience selecting only the best Kratom leaves. After specialized drying techniques, the leaves are crushed and made into the kratom you can buy online today.

Can I Buy Kratom In Colorado?

Short answer - yes, but. Colorado is divided when it comes to kratom legality. For those 21+, you can buy, sell, and use kratom in most of the state, although it is heavily regulated and restricted. However, you cannot buy, sell, or use kratom at any age in the towns of Parker or Monument, but you can still possess it. While you can get kratom in Denver, all vendors must label their products ‘not for human consumption’. This legislation has also restricted kratom sellers from providing any type of advice or recommendations on kratom, making which kratom products to try tricky.

History of kratom legality in Colorado
Colorado is one of only five states that have passed a version of the Kratom Consumer Protection Act. It was a long legislative road that came to a close in 2022 with a win for kratom users.

In June of 2022 Senate Bill 22-120 was passed. It establishes simple regulatory guidelines for kratom in Colorado. The Colorado version of this bill is similar to kratom regulations in the states that have already passed the KCPA—Nevada, Utah, Arizona, Oklahoma, and Georgia. It will mark a new era in Colorado’s kratom industry.

Regulations instituted to keep kratom safe include some of the following measures:

  • Prohibiting sale of kratom to certain age groups (ban of sale to minors – in most cases)
  • Requiring special labeling and packaging instructions
  • Placing quality control requirements (like lab testing) on all kratom products
  • Setting forth clear processing and storage requirements
  • Defining penalties for violation of policy

While this was a win for the state, kratom remains illegal in the towns of Monument and Parker. This started in October 2019, with the town of Parker becoming the first Colorado location to ban kratom sales. The town council made their decision by siding with the FDA. They used references from the Mayo Clinic and the poison center complaints to back up their decision to ban this helpful herb. Just a month after Parker reached their final decision, Monument also decided to ban the retail sales of kratom.

While Colorado state’s government is in support of kratom, it’s not this way for all states. Many kratom users still face the possibility of bans in all or parts of their state and are not protected by the KCPA.

The AKA and The Fight to Make Kratom Federally Legal and Regulated
Founded in 2014, the American Kratom Association’s vision has always been to protect the rights and safety of kratom users across the nation. Since kratom is not being regulated at a federal level, each state is left to decide how they want to handle this herb and there are no federal standards to regulate manufacturers and distributors of kratom, meaning that not all the kratom you can buy is safe. The American Kratom Association, also known as the AKA, is the consumer advocate group for kratom users throughout the United States..

Thanks to the AKA, not all legislative efforts that affect kratom users and kratom vendors are prohibitive. They are working to get all states on board with the Kratom Consumer Protection Act. This act will help regulate the kratom industry – keeping consumers safe and providing kratom manufacturers a set of safety standards to follow. The AKA actively monitors federal, state, city, and municipal legislation in the battle for kratom legality.
